Terms of Service

The agreement between EnziMPya and the internet service providers who use the platform. Please read it before you sign up.

Last updated 25 October 2026

1. The agreement

These terms apply between EnziMPya ("we", "us") and the business that creates an EnziMPya account ("you", "the ISP"). By creating an account or using the service, you accept them. If you accept on behalf of a company, you confirm that you have the authority to do so.

2. The service

EnziMPya is software for running an ISP. It covers subscriber billing, payment collection, router and RADIUS management, captive portals, notifications, a subscriber mobile app and reporting. We may improve or change features over time. If we plan to remove a feature you rely on, we will give you reasonable notice.

3. Your account

  • Keep your login details secure and turn on two-factor authentication for staff accounts. You are responsible for everything done under your account.
  • Give us accurate contact details, so we can reach you about your account, billing and security.
  • You are responsible for your routers, network equipment and internet uplink. You must also keep access to the routers you connect to EnziMPya.

4. Fees

  • Free trial: new accounts get 14 days free, and no card is needed.
  • Hotspot plan: 2% of the hotspot revenue collected through the platform each month.
  • PPPoE plan: KSh 20 per active subscriber per month.

The current prices are always shown on our pricing page. If we change them, we will give you at least 30 days' notice. If a payment is overdue, we may limit your dashboard after reminding you. Your subscribers' existing data is not deleted because of late payment.

5. Payments from your subscribers

You can collect payments into your own M-Pesa Paybill or Till, using your own Daraja credentials. In that case the money goes straight to you, and you deal with Safaricom under your own agreement with them. You are responsible for the prices you charge your subscribers, for refunds and for the service you give them.

6. Acceptable use

You agree not to use EnziMPya to:

  • break Kenyan law, including the Kenya Information and Communications Act and its regulations, or the Data Protection Act, 2019;
  • send spam or SMS messages your subscribers have not agreed to receive;
  • try to reach another ISP's data, probe or overload the platform, or get around its limits;
  • resell the platform itself without our written agreement.

You are responsible for holding any licences your ISP business needs, such as those from the Communications Authority of Kenya.

7. Your data

Your data and your subscribers' data belong to you. We use it only to provide the service, as described in our Privacy Policy. You are responsible for having a lawful basis to collect your subscribers' data and for telling them how you use it.

8. Availability and support

We work to keep EnziMPya running at all times and to fix problems quickly. Sometimes there will be planned maintenance or outages caused by things outside our control, such as internet backbone, power or Safaricom outages. Support is available on WhatsApp and email, as listed on our contact page.

9. Ending the agreement

You can stop using EnziMPya at any time. If you ask before closing your account, we will export your subscriber and payment data for you. We may suspend or close an account that seriously or repeatedly breaks these terms, usually after giving notice and a chance to fix the problem. We will not give notice first if the platform or other ISPs are at immediate risk.

10. Liability

The service is provided "as is". To the extent the law allows, we are not liable for indirect losses, such as lost profits or lost subscribers. Our total liability for any claim is limited to the fees you paid us in the three months before the claim. Nothing in these terms limits liability that cannot be limited under Kenyan law.

11. Changes to these terms

We may update these terms from time to time. If we make a significant change, we will tell you at least 14 days before it takes effect. If you keep using the service after that date, you accept the new terms.

12. Governing law

These terms are governed by the laws of Kenya, and disputes are decided by the courts of Kenya. Before taking a dispute to court, we would like you to contact us at info@enzimpya.com so we can try to resolve it together.
